General Conditions

The general conditions set out here will apply as regulations for the contracting of LOCKER BONAIRE lockers, as well as for their operation and use.

In this regard, the conditions will apply to the contractual relationship between LOCKER BONAIRE and the service user. The deposit contract is stipulated with the company LOANPROPERTYLOCK, S.L.U., owner of the name LOCKER BONAIRE and the website lockerbonaire.com, which accepts the deposit. By consigning your luggage, you accept our terms and conditions regarding the deposit contract, on your behalf and/or on behalf of any other person who has an interest. Our terms and conditions are of general application, with changes only agreed upon in writing and approved by management.

WHAT USE CAN BE GIVEN TO THE LOCKERS OWNED BY LOCKER BONAIRE?

This document regulates the limits and possible uses of the lockers. Based on these, a user can place as many suitcases as they want inside the rented locker(s).

WHAT IS THE MINIMUM AND MAXIMUM DURATION FOR CONTRACTING THE SERVICE OFFERED BY LOCKER BONAIRE?

The period will depend on what the user needs. However, it ranges from a minimum period of 24 hours (from 00:00 hours on day x, until 00:00 hours the following day), and the time the user takes to retrieve their belongings.

WHEN CAN THE USER USE THE LOCKER SERVICE OFFERED BY LOCKER BONAIRE?

The service will be available once contracted, 24 hours a day, 365 days a year.

ONCE THE USER HAS DEPOSITED THEIR BELONGINGS, WHO CAN ACCESS THE ESTABLISHMENT TO RETRIEVE THEM?

Only users who have contracted the service using their personal code will have access to the establishment. However, if the user provides the code to third parties, and the third party accesses it, they will do so under the primary user’s responsibility.

WHAT IS THE PROCEDURE TO FOLLOW IN CASE OF ANY INCIDENTS WITH THE LOCKERS OR THE ESTABLISHMENT?

In case of any other type of incident, the user will have access to LOCKER BONAIRE’s customer service, which can be contacted via email at help@lockerbonaire.com or WhatsApp +34 694278143.

HOW FAR IN ADVANCE CAN I MODIFY OR CANCEL MY RESERVATION?

The reservation can only be modified up to 24 hours before it starts.

CAN I MODIFY OR CANCEL MY RESERVATION?

If the booking is made through the website www.lockerbonaire.com, the User can cancel their reservation up to 24 hours before the start date. For these purposes, reservations are understood to start at 00:00 on the contracted start date. If the cancellation is made after these 24 hours, LOCKER BONAIRE will not refund the amount paid by the User. All procedures must be carried out via email at reservas@lockerbonaire.com.

ACCESS AND RESERVATION

To use the smart locker service offered by LOCKER BONAIRE, it is essential to meet at least the following requirements:

  • Be at least 16 years old.
  • Fill in personal, service, and payment details accurately and truthfully in the reservation field on the LOCKER BONAIRE website.
  • Accept the general conditions for contracting the service and its use.
  • Accept the LOCKER BONAIRE privacy policy.

Once the previous steps have been accurately completed, the user will receive a reservation confirmation by email. The confirmation email will include the assigned locker number(s), the reserved day(s), and the access codes to the establishment and locker(s).

USER OBLIGATIONS AND LIMITS ON THE USE OF THE LOCKERS

The user, upon accessing and accepting the service contract conditions offered by LOCKER BONAIRE, expressly agrees to:

  • Use the facilities appropriately and according to the rules of good use, specifically ensuring that the locker(s) and the establishment’s access door are properly closed when the user leaves.
  • Not use the lockers for purposes not allowed by current legislation. Specifically, they commit to not store or deposit objects whose mere possession or trafficking is not permitted by authorities or specific regulations (such as stolen goods, drugs, pornographic materials, or anything degrading to human beings, etc.).
  • Not store any object that requires a license or authorization (such as weapons of any kind).
  • Not introduce any type of flammable, contaminating material, or anything that could be a danger to other users or the facilities (such as flammable objects or hazardous or contaminating substances).
  • Not use the lockers to store or deposit animals or any living being.
  • Not introduce any biodegradable substance into the lockers, such as food or drinks, to prevent damage to the facilities.
  • Ensure that the security code provided for using the LOCKER BONAIRE service is not transmitted or given to third parties, being strictly responsible for any consequences that may arise from such transmission.
  • Not use the lockers to deposit goods that a third party must collect. The lockers should not be used as a means of trafficking goods between parties. This is a use not authorized by LOCKER BONAIRE.
  • The user may not remain in the establishment longer than strictly necessary to deposit or retrieve their belongings.
  • Not eat or drink alcoholic beverages inside the premises.
  • Ensure that the lockers are in the same condition they were in when possession was taken of them, at the end of the reservation period. Specifically, notify LOCKER BONAIRE via email at help@lockerbonaire.com of any damage or incidents that may arise from their use.
  • Not take photographs or videos inside the LOCKER BONAIRE premises and of their security mechanisms.
  • Not include money, jewelry, technological items (tablets, computers, televisions, etc.), or items of special value in the lockers. The user’s decision to use the rented lockers to store such valuable items is solely and exclusively their responsibility.

LIABILITY AND CONSEQUENCES FOR THE USER OF THE SERVICE ARISING FROM BREACH OF THEIR CONTRACTUAL OBLIGATIONS

The user must hold LOCKER BONAIRE harmless from any damage or loss resulting from non-compliance or lack of diligence regarding their obligations under this contractual document.

FAILURE TO COMPLY WITH THE LOCKER SERVICE CONTRACT TERM

LOCKER BONAIRE reserves the right to empty the lockers for failing to comply with the contract term, to manage the shipment of belongings to the user (with such return being 100% at the user’s expense). After fifteen days without being able to contact the user or without the user contacting LOCKER BONAIRE and without being able to deliver the belongings, it will be interpreted that the goods have been abandoned by the user for all purposes. In such a case, LOCKER BONAIRE will cease to keep them, disposing of them as it deems appropriate.

For every 24 hours that pass from the expiration of the contracted service period without the locker(s) being vacated by the user until its delivery or collection by the user, a penalty of one full day’s rental at the stipulated locker rate will be set.

Additionally, a €90 penalty will be generated, which the user must pay to LOCKER BONAIRE for management costs,

For the management of returning belongings with transport companies chosen at LOCKER BONAIRE’s discretion, a €60 commission will be added to the transport cost and the penalty established in the previous point, in favor of LOCKER BONAIRE. LOCKER BONAIRE, like the transport company, will be exempt from all risks of damage that may occur during the return process.

The return of belongings will be carried out once LOCKER BONAIRE has received payment of the amounts specified in the previous sections from the user. If more than 12 calendar days have passed since LOCKER BONAIRE notified the user in writing of the amount to be paid and the user has not made this payment, it will be understood for all purposes that the user has abandoned the return of their belongings. Therefore, LOCKER BONAIRE will proceed according to the terms specified above for abandoned goods, which may be deposited in the lost and found section managed by the City Council of Palma de Mallorca.

NON-COMPLIANCE WITH THE RULES OF USE ESTABLISHED IN THIS DOCUMENT

LOCKER BONAIRE reserves the right to remove any item known to be non-compliant with the locker use regulations, even if it is not allowed under these conditions. In this case, LOCKER BONAIRE will be authorized to call the authorities and security forces, as well as to report the said conduct.

The user will be solely responsible for the items deposited in the lockers owned by LOCKER BONAIRE.

In this regard, the user, upon understanding and accepting the contract conditions, will be fully responsible for any damage or deterioration that may occur to the lockers due to improper or inadequate use. In such a case, the user will be obliged to compensate and restore LOCKER BONAIRE for the physical damage caused to the locker(s), as well as for lost profits.

PAYMENT OF PENALTIES BY THE USER

The penalties established in these terms and conditions of use will be paid by the user using the same payment method used when contracting the service or via bank transfer to the account indicated by LOCKER BONAIRE.

The user expressly agrees that LOCKER BONAIRE will proceed to collect the amounts established in this section using the user’s payment card or method when contracting the service. .

OBLIGATIONS OF LOCKER BONAIRE

LOCKER BONAIRE is obliged to keep the locker service active and to make the locker(s) contracted by the user available to them in good working order for the contracted period.

Additionally, LOCKER BONAIRE is obliged to resolve any incidents that may arise in the use of the lockers as quickly as possible.

LIMITATION OF LIABILITY BY LOCKER BONAIRE

LOCKER BONAIRE offers users a space rental service for storing their belongings, however, it will not be responsible for the safekeeping of the belongings. The user will be solely responsible for the items placed in the rented lockers.

The user, if necessary, will be the one to file the corresponding report with the competent authorities in the event of theft (regardless of whether LOCKER BONAIRE takes its own measures).

Although LOCKER BONAIRE has insurance to cover certain cases of loss of belongings, such insurance will not cover the theft of cash or virtual money, jewelry or bijouterie, such as precious stones or others, watches, plasma screens, and generally technological items of any kind (LCD, GPS navigators, mobile phones, computers, tablets), works of art, or data storage systems such as cards or other means or devices that may contain or store data.

COMPLAINTS AND SUGGESTIONS

When the user deems it appropriate to file a complaint or suggestion, they can do so by sending an email to the following address help@lockerbonaire.com.

At LOCKER BONAIRE, we will try to resolve the incident and find a solution that looks after the interests of both parties.

Likewise, if the User is not satisfied with LOCKER BONAIRE’s response, they have the option to file a complaint with the consumer authorities.

APPLICABLE LAW AND JURISDICTION

The applicable law will be Law 7/1998, of April 13, on general contracting conditions.

In this regard, the parties will submit to the jurisdiction of the Spanish Courts and Tribunals to resolve any disputes arising from this Contract.
